Texas fatal accident kills woman, child critically injured

Car accident investigators in Texas are blaming one motorist for the death of a 60-year-old woman and critical injuries of a 2-year-old girl. Officials say that the driver deemed responsible for the fatal accident was headed north on Texas 304 when he apparently veered into the southbound lane, crashing into a pickup truck. The man was arrested for intoxicated assault and intoxicated manslaughter.

It is not yet known whether the toddler will survive her injuries caused by the alleged drunk driving of the 23-year-old motorist. One state trooper involved in the investigation said that the another charge of intoxication manslaughter may be added to the charge already filed against the man if the child dies. The woman who died in the tragedy was said to be a temporary caretaker of the young girl.

Drunk driving remains an ongoing problem in the state and throughout the nation. A family who suffers the untimely death of a family member because of a drunk driver may experience feelings of anger and frustration in addition to their grief. It is understandable that those in such circumstances desire justice to be served on behalf of their deceased loved one.

In Texas, an immediate family who survives a victim of a fatal accident caused by an intoxicated driver may file a wrongful death claim in a civil court. Once the burden of proof has been met by the plaintiff, the court may issue a monetary judgment against the person or persons found responsible for the death. Though court-awarded compensation can never replace the loss of a human life, it can serve as a form of debt relief for monetary damages associated with the accident.
