Texas truck accident leads to wrongful death suit

A trucking company is facing a legal battle with the family of a Texas man who was killed in a tragic accident. The family is seeking damages in a wrongful death suit to cover medical and funeral expenses, as well as loss of income, loss of support, mental suffering, grief and other forms of injury.

The truck accident occurred while one of the company's employees was pulling a flatbed trailer with a truck. When the employee missed his turn, he backed his trailer up onto a road with oncoming traffic in order to turn around. Unfortunately, a man was traveling on the road at the time and collided with the trailer. The man suffered from severe injuries that led to his death.

The lawsuit alleges that the employee was negligent in backing up the trailer across a road with oncoming traffic. The suit also says that the man could not see the trailer due to the darkness and because the positioning of the truck appeared to be normal. The employee was charged with criminally negligent homicide after the Texas Department of Safety ruled that he was inattentive and not cautious when backing up his vehicle.

Traffic accidents involving trucks can often be even more devastating than accidents involving cars or motorcycles because of the size and weight of the trucks. Truck drivers owe a duty to other people on the road to exercise reasonable care when operating their vehicle. If a driver breaches this duty, and someone gets hurt or dies because of this breach, the driver may be held liable. If the driver works for a truck company and was on the job at the time of the accident, the company can be held liable as well. Wrongful death suits give the victim's families a way to recover and help them move on from their tragedy.
