Family of oilfield worker files wrongful death suit

The family of a recently deceased oilfield worker is filing a wrongful death suit against two Texas companies. The suit alleges that Forge Energy LLC and Thornton Drilling Co. were grossly negligent and that their negligence was a cause of the man’s death. The 20-year-old man was hired last year by Thornton and was killed after just five days of work. Thornton contracted with Forger to operate a rig and the man was electrocuted while using a power washer located outside the generator house.

The man’s fiancé and two young children hope to recover damages after this fatal workplace accident. With the recent oil boom, Texas companies have not always ensured the safety of their workplaces. When a company has been grossly negligent, they may be held liable for the death of an employee on the job. Wrongful death suits stemming from occupational exposure to dangerous work conditions are some of the more common types of suits.

Families filing wrongful death suits will need to show that the company was negligent and that the negligence led to the death of their loved one. The family also must have suffered some sort of monetary loss as a result of the death. When determining the amount of damages a family should receive, the court will consider the amount of financial injury the family has endured. This includes loss of prospect of inheritance, loss of support and medical expenses. When the deceased is a working adult with children, the court will consider the loss of income and loss of parental guidance when determining damages. Once the damages are awarded, the family can begin the long process of recovery.
