Lawsuit brought over 'Star Trek' actor's death

One of the things wrongful death lawsuits are sometimes based off of are allegations that there was a safety problem with a given vehicle. This is illustrated in a wrongful death case that has come up in connection to the death of actor Anton Yelchin.

Many may recognize Yelchin from the recent "Star Trek" movies, in which he played Pavel Chekov. Yelchin died on June 19, when he was pinned by his SUV between a security fence and a mailbox in his driveway. The pinning happened when the SUV rolled backward. The SUV was a 2015 Jeep Grand Cherokee.

Yelchin's parents are suing the maker of this model of SUV in California in relation to this fatal accident. In the lawsuit, Yelchin's parents allege that the accident was the result of problems with the gear selector in the SUV that caused the SUV to not be in park when it rolled backward. This selector was unsafe, designed poorly, manufactured poorly and defective, according to the parents' accusations.

This model of SUV is among the automobile models that are subject to a gear-selected-related recall. The recall began this April. Yelchin's parents allege that the maker's recall and safety actions related to the gear selector were insufficient.

Cases like these can involve a great deal of evidence, including evidence touching on:

  • How a given fatal accident actually happened.
  • The characteristics and condition of an automobile part alleged to have contributed to a fatality.
  • The design of a given auto part.
  • The manufacturing of a given auto part.
  • The safety steps an automaker took (or didn't take).
  • How an automaker responded when safety concerns were raised regarding an auto part.

So, wrongful death cases involving allegations of defective auto parts can get very complex from an evidentiary standpoint. One wonders what pieces of evidence will be presented in and end up being central issues in the case involving Yelchin's death.

Preventing future similar accidents, getting the automaker to change its safety practices and punishing the automaker are among the aims Yelchin's parents reportedly have for their lawsuit. As this illustrates, there can be a diverse range of goals a family of a person killed in a vehicle-related accident may have for a wrongful death case. Skilled attorneys can help families here in Texas who are bringing wrongful death lawsuits with tailoring their overall strategy in their case to their goals.
