Is The Trucking Industry Trying To Remove Safety Regulations?

Truck drivers can spend many uninterrupted hours on the road. Many drive day and night. Not surprisingly, one of the biggest reasons for truck accidents is driver fatigue. However, in August, the trucking industry made a move to lift rules that require truck drives to take breaks.

An Attempt To Remove The Mandatory Break Rule

According to an article in Overdrive Online, the Commercial Vehicle Safety Alliance (CVSA), an alliance who acts for local, state, and national field inspectors for trucks and buses, wanted to remove a regulation put in place on July 1st, 2013, requiring truck drivers take a mandatory 30 minute break for 8 hours of drive time.

Thankfully, the Federal Motor Carrier Safety Administration (FMCSA) refused the request to remove the rule, stating there was evidence from the past few years (2013, 2014, and 2015) that indicate the mandatory break rule should be in place. The rule had previously been upheld by a U.S. Appeals Court.

Having truck drivers take a 30 minute break every 8 hours on the road is not an outlandish request. However, allegedly the CVSA does not believe rules such as the 30 minute break can be enforced. They say driving records and log books are often fabricated in order to comply with the rule.

The FMCSA claims that based on documented infractions given by inspectors, officials are able to, and should continue to, enforce regulations requiring the breaks. They state that enforcing the rule does not seem to be an issue as it stands. It is in place for safety reasons, and if revoked could potentially lead to an increase in truck accidents.
