Family of 4 killed in Christmas Eve accident in Raymondvile

Family members of the sole surviving daughter of a man, who lost his life along with that of his two sons, ages 8 and 14, and his female partner on Christmas Eve 2016, filed a lawsuit on Dec. 26 demanding $1 million in damages for their wrongful deaths. The driver and his trucking company are listed as defendants in the filing.

The family was traveling eastbound along Willacy County's FM 186, near FM 1834 around 11:30 a.m., when the fatal is alleged to have occurred. At the same time, the trucker said to be responsible for having caused the accident, was traveling westbound along the same road.

An investigation by the Texas Department of Public Safety determined that the driver of the semi truck lost control of his trailer before crashing head-on into the decedent's' 2005 GMC pickup. All four family members died instantly on the scene.

Although drizzling rain is suspected to have played some role in causing the accident; the responding officer cites the the trucker's "driving at an unsafe speed" as the main culprit for the deadly crash. The Willacy County sheriff corroborates DPS' sentiments, saying that the trucker was determined to have been driving "too fast for existing conditions," although the speed at which he was traveling has yet to be released.

The wrongful death lawsuit filed against the trucker alleges he was negligent, especially with regards to "exercising ordinary care" and operating "the vehicle in a reasonable and prudent manner". At the same time, the filing asserts that the man's employer was "responsible for screening, hiring and booking" the trucker, someone the family alleges was "not fit to drive and should have never been put on the road".

In addition to the civil suit, the man was charged with four counts of criminally negligent homicide for his role in causing the deaths of the Lasara family. The man has since been released on bond. If you or someone you know has been involved in a permanently debilitating or deadly car crash as a result of the negligence of another, a Houston, Texas, personal injury attorney can help you understand your legal options.
