What to do after a careless driver has struck your car

You are driving along the highway, excited for an enjoyable day of shopping and dinner. However, all of a sudden, you see another motorist attempt to make a left turn in front of you. The motorist hesitated at first and then decided to accelerate. Unfortunately, he did not go fast enough, and as a result, you both end up colliding.

You realize that the other driver was in the wrong, as you had the right-of-way. However, understandably, the crash has shaken you up emotionally, and you are also feeling physical pain. Fortunately, you have the right to seek compensation for any injuries you may have suffered in the accident. Here are some important steps to take immediately following the crash to protect your best interests in Texas.

Contact police

As soon as the accident has occurred, it is important that you check on any other passenger and driver whom the crash impacted. The faster you do this, the more quickly you can seek medical help for anybody who has suffered debilitating injuries.

Then, it is in your best interest to contact police. The responding police officer will collect information from you and the other driver, and then file a report on the accident. Before the officer leaves, you may want to ask him or her where you can access the report after the filing of it. The report may prove handy for corroborating your version of events of the accident in court.

Gather information

In addition to talking to police, you might want to gather the name, phone number, address and driver's license information of the driver who caused your accident. His or her insurance information and license plate number are also helpful pieces of information to collect.

During your interaction with the other driver, it is wise to avoid apologizing for anything. Otherwise, you might be admitting liability for the accident, even if this was not necessarily your intention.

Your rights following an injury crash in Texas

Following an injury crash caused by another individual's negligence, you have the right to seek compensation for your injuries through a personal injury claim. You need to establish liability in civil court before a judge will decide claims for monetary damages. If you prevail in your claim, a judge may award you damages that might assist you in paying for your medical bills and other losses related to the collision.
